Further to my previous email, I'm inferring from Bennett Landman's message that Neuromorphometrics knew about (and was involved in) the provision of data under a CC BY-NC license as part of the MICCAI 2012 challenge https://masi.vuse.vanderbilt.edu/worksho... in which case that's a fairly clear blessing of the NC clause for the included data covering research use consistent with the challenge.
(For what it's worth I'd like to wish Morphometrics the best of luck with their business model, getting consistent manual segmentations of large numbers of scans is an amazingly useful resource. As has been pointed out actually acquiring MRI scans isn't free either, and researchers in other fields are used to paying for reagents or lab tests from commercial companies.)
