Just make sure to cite the website (http://www.nitrc.org/projects/ibsr) and mention it in the acknowledgements.

RE: Permission to used IBSR data set
You do not need to get permission to use the IBSR data for
publications because that is the purpose of this resource.
Below is the README file for the IBSRV2. It is a little
inaccurate because the data was moved to NITRC and you should
reference the current link to the data.
Best wishes,
Andy.

Andrew,
Thanks for sharing the README file.
There is a contradiction between your statement,
and the content of the README:

RE: Permission to used IBSR data set
D'oh! You're absolutely right, Luis. I love it when
people pay attention to the details.
I did not update the README files when I just copied the IBSR over to NITRC. I don't know what to do about this inconsistency. I don't have authority to change the "license" since it was created at Massachusetts General Hospital. It costs so much to produce manual anatomical labels, the PIs that Dave Kennedy convinced to release data were mainly concerned that doing so might come back to hurt their ongoing research. As the keeper of the IBSR web site, I always said yes anytime anybody asked if they could publish because the goal of the IBSR was to encourage academic uses of the data.
Andy.

RE: Permission to used IBSR data set
Hello!
I was looking on this thread about using IBSR, I am just starting on this data set and still confused a bit. Andrew Worth thanks for sharing this README file. It gives me more idea now.
